Terms of Service

1. Acceptance of Terms

By accessing or using HypeHyena ("the Platform"), operated by Edbo Apps (Pty) Ltd, a company registered in South Africa, you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our Cookie Policy. If you do not agree, do not use the Platform.

You must accept these Terms during account registration. Your first visit to the Platform also presents a cookie consent banner — you can accept all categories, reject non-essential categories, or customise per category at any time via the "Cookie preferences" link in the site footer. Continued use after any update constitutes acceptance of revised Terms. We will notify you of material changes via email or in-app notification at least 14 days before they take effect.

2. Definitions

Platform: The HypeHyena web application and all associated services.
Creator: A user who funds campaigns with prize pools to drive traffic.
Earner: A user who shares campaign links and competes on leaderboards.
Campaign: A time-limited promotion funded by a Creator with a prize pool.
HypePoints: A non-monetary scoring metric earned through platform participation. HypePoints have no cash value and cannot be redeemed, exchanged, transferred, or sold.
Cred:A reputation rating calculated from an Earner's performance.
Prize Pool: The monetary amount funded by a Creator and distributed to top-performing Earners as digital rewards.

3. Eligibility

You must be at least 18 years of age to use the Platform.
You must provide accurate and complete registration information.
One account per person. Multi-accounting is prohibited and will result in permanent ban.
Users in sanctioned jurisdictions (as determined by applicable law) are not permitted to use the Platform.

4. Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately at support@hypehyena.com if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts that violate these Terms or exhibit fraudulent behavior.

5. Platform Description

HypeHyena is a performance-based marketing platform where Creators fund campaigns with real prize money and Earners compete by sharing links to drive verified human traffic. Top-performing Earners win digital rewards.

HypeHyena is NOT a lottery, gambling platform, or game of chance. Prize distribution is based entirely on measurable performance (verified clicks and conversions). Winners are determined by objective leaderboard rankings, not random selection.

No purchase is necessary to participate as an Earner.Earners create free accounts and share campaign links at no cost. Each campaign's competition rules, including eligibility, entry period, winner determination, and geographic restrictions, are available on the campaign page.

6. HypePoints and Cred

HypePoints are a non-monetary scoring metric with no cash value.
HypePoints cannot be purchased, sold, exchanged, transferred, cashed out, or redeemed for any form of currency, goods, or services.
HypePoints do not constitute property, stored value, virtual currency, or financial instruments of any kind.
We reserve the right to adjust, modify, or reset HypePoints balances at any time without notice or compensation.
Trading, selling, or attempting to assign monetary value to HypePoints or accounts is a violation of these Terms and grounds for immediate account termination.
Cred is a calculated reputation rating that may affect platform features.
Neither HypePoints nor Cred create any obligation on our part to provide monetary compensation.

7. Campaigns and Prize Distribution

For Creators:

Creators fund campaigns by paying a prize pool amount plus applicable platform and processing fees as displayed during checkout.
Campaign content is subject to moderation. Content that violates our guidelines will be rejected.
Prize pools are distributed to top-performing Earners upon campaign completion.
Each campaign is governed by competition rules available on the campaign page, including eligibility criteria, entry period, winner determination method, prize descriptions, and geographic restrictions.
Campaigns are non-cancellable and non-refundable once launched. When your campaign transitions from the draft state to the active state (immediately after your payment is confirmed), Earners begin sharing your link and you have received the benefit of the promotional distribution. You may pause a live campaign, but the end date is not extended and settlement still occurs at the scheduled time. You may not cancel or refund an active campaign.
Top-ups, boost purchases, and extension purchases are non-refundable. These purchases take effect immediately on payment confirmation and cannot be reversed.
If a campaign receives zero verified conversions at settlement, the prize pool is refunded automatically. Platform fees and processing fees remain non-refundable in all cases.
If content you edit after launch is rejected during re-moderation, your campaign is paused until the content is fixed or the edit window closes. This does not entitle you to a refund.
You may not delete your HypeHyena account while you have any campaign in the active, paused, or settling state. Close or let your campaigns run to completion first.
If you initiate a chargeback with your bank for a campaign that was delivered (your campaign ran, Earners shared links, clicks were verified, prizes were delivered), we will contest the chargeback using our full evidence record. Repeated unauthorized chargebacks may result in account termination.

For Earners:

Earners participate by sharing unique campaign links and driving verified human traffic.
Prizes are delivered as digital rewards. No cash alternatives are offered.
Reward availability depends on your selected country during onboarding.
Prize eligibility requires genuine, organic sharing. Artificial, fraudulent, or bot-generated traffic disqualifies the participant.

8. Payments and Subscriptions

All payments are processed by our authorized payment processor, which acts as the Merchant of Record for all financial transactions. By making a payment, you also agree to the payment processor's terms.

All payments are non-refundable except as expressly provided in §7 or §8. See §7 for campaign-refund rules (zero-conversion auto-refund and moderation-rejection edge case) and the rules below for subscription-refund behavior.

Subscription plans are available at prices displayed on the Platform. Benefits and pricing may change with notice.
Subscription billing runs to the end of your paid period. Monthly subscriptions are charged every 30 days; yearly subscriptions every 365 days. Canceling prevents the next renewal but does not refund the current period — you retain all benefits until your scheduled period-end date.
Subscription payments are non-refundable. Canceling during a billing period does not entitle you to a prorated refund for the unused portion.
Upgrades (e.g. Monthly → Yearly or to a higher tier) take effect immediately with automatic proration by our payment processor — you are charged the difference, and unused time from the prior plan is credited.
Downgrades(to a lower tier or plan) take effect at the end of your current billing period. You retain your original plan's benefits until then.
Payment failure: if a renewal payment fails, benefits continue for a 7-day grace period during which you may update your payment method in Settings. After the grace period, benefits revert.
No free trials. HypeHyena does not offer trial periods for any paid product. The advertised price is the price you pay from day one.
Subscription chargebacks: if you initiate a chargeback for a subscription charge you legitimately authorized, we will contest the chargeback using our full record of your Terms acceptance, subscription receipts, and access logs. Repeated unauthorized subscription chargebacks result in account termination.
Subscription cancellation takes effect at the end of the current billing period.
Refund requests are handled in accordance with the payment processor's refund policy and applicable consumer protection laws.

9. Creator Obligations

Campaign content must be truthful, non-deceptive, and comply with all applicable advertising laws.
Prohibited content includes: illegal products or services, adult content, hate speech, violence, misleading claims, and content that violates third-party intellectual property rights.
Creators are responsible for ensuring their campaigns comply with laws in their jurisdiction.

10. Earner Obligations

Earners must share links through genuine, organic means. Prohibited methods include: bot traffic, click farms, self-clicking, incentivized clicks, misleading links, and spam.
Verification measures are used to ensure traffic quality. Attempting to circumvent these measures is a violation of these Terms.

11. Referral Program

Users may refer others via a unique referral link. Referral bonuses may be offered at our discretion.
Referral bonus amounts are discretionary and may be modified or discontinued at any time.
Self-referrals and fraudulent referral schemes are prohibited.

12. Intellectual Property

All Platform content, design, code, logos, and trademarks are owned by Edbo Apps (Pty) Ltd or its licensors.
By submitting campaign content, Creators grant the Platform a non-exclusive, worldwide, royalty-free license to display and distribute that content within the Platform for the duration of the campaign.
Users retain ownership of their original content but may not use the Platform to infringe on third-party intellectual property.

13. Prohibited Conduct

The following conduct is prohibited and results in immediate account termination plus, where applicable, forfeiture of HypePoints, Cred, and any unredeemed prizes or referral commissions:

Creating multiple accounts (beyond the 3-per-device limit) for any purpose — including referral farming, bonus accumulation, leaderboard manipulation, or evading fraud detection
Selling, trading, or transferring your account, HypePoints, Cred, or referral code to another person — accounts are non-transferable
Using automated tools, bots, browser extensions, or third-party services to generate clicks, share links, or complete actions on behalf of real users
Collusion between Creators and Earners to artificially distribute prize pools
Funding campaigns with payment methods that are not legitimately yours (stolen cards, fraudulent payment sources). Such campaigns are cancelled, prizes are voided, and the account is banned
Attempting to claim referral rewards for accounts that do not represent real independent users (sock-puppet referrals)
Initiating chargebacks or payment disputes for services legitimately delivered — subscription periods used, campaigns that ran, prizes that were issued
Attempting to redeem a prize multiple times by claiming non-delivery after you received the delivery email or redemption link
Bypassing or attempting to bypass the two-factor authentication requirement applicable to high-reputation accounts
Circumventing country-based eligibility restrictions via VPNs, proxies, or other tools to appear in a different country from your actual residence

You also agree not to:

Attempt to reverse-engineer, decompile, or disassemble the Platform
Use the Platform for money laundering, fraud, or any illegal purpose
Harvest user data or scrape Platform content without authorization

14. Termination, Suspension, and Account Deletion

We may suspend or terminate your account at our discretion for violations of these Terms, fraudulent activity, or abuse. If your account has been banned, deleting your account does not remove the ban — the same email address remains blocked from re-registration.
Upon termination by us: access is revoked, pending prizes are forfeited, HypePoints are voided, and subscriptions are cancelled.
You may delete your account at any time through Settings. Deletion requests enter a 24-hour cooling-off period during which you can revoke the request via a link sent to your email. After the cooling-off period, the deletion is irreversible.
Prize forfeiture on voluntary deletion: any unredeemed prize owed to you at the moment your deletion request is submitted is forfeited to the platform. This includes pending prize deliveries that have not yet been sent to the reward processor. Digital rewards already issued to you retain their original redemption window (typically 180 days) and may still be redeemed by you during that window.
Referral commission forfeiture: any creator-referral commissions payable to you but not yet delivered are forfeited to the platform on deletion.
Data handling on deletion: your personally identifying information is removed from our database on commit. Financial records, fraud-prevention records, and audit logs are retained for the period required by the Companies Act (7 years), FICA (5 years), SARS, and payment-processor dispute rebuttal. 15. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied.
We do not guarantee any level of earnings, prize winnings, or traffic volume.
We are not responsible for third-party service interruptions.

16. Limitation of Liability

To the maximum extent permitted by applicable law, Edbo Apps (Pty) Ltd and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

Our total aggregate liability for any claims arising from your use of the Platform shall not exceed the amount you have paid to us in the 12 months preceding the claim.

17. Governing Law and Disputes

These Terms are governed by the laws of the Republic of South Africa. Any dispute shall be resolved through good-faith negotiation, followed by mediation, and if necessary, the courts of South Africa shall have jurisdiction.

Nothing in these Terms limits your statutory consumer protection rights under applicable law.

18. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 14 days before taking effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
